ADMINISTRATIVE MEDIATION AS AN INNOVATIVE INSTITUTE FOR RESOLVING PUBLIC LEGAL DISPUTES IN UKRAINE

The article reveals the innovativeness of the administrative mediation procedure for Ukraine from the point of view of implementing established European traditions of using an alternative method of resolving public-law disputes. It is shown that administrative mediation is one of the elements of building a legal and dialogical culture of civil society, which contributes to the awareness and acceptance by citizens of responsibility for the powers delegated to them by the state. The important role of the 2022 recommendations on the effectiveness of justice, which have become an important reference point for the member states of the Council of Europe in the implementation of administrative mediation, is shown. The author argues that for Ukraine, the implementation of these recommendations will not only indicate the harmonization of our legal system with European legal systems, but will also contribute to the establishment of values and priorities for development based on the principles of democracy and humanism. Arguments are presented regarding the mediality of public law disputes, the adoption of a decision on which requires taking into account legislative restrictions that arise in connection with the specifics of public law disputes, the imperative nature of legal norms that regulate the activities of public administration bodies and are aimed at protecting public interests.
